FilmShuffle Copyright and DMCA Policy

FilmShuffle respects copyright and expects users to do the same. This Policy describes how to submit a copyright-infringement notice, how a user may submit a counter-notice, and how FilmShuffle handles repeat infringement.

This process is for copyright claims. It is not the correct process for trademark, defamation, privacy, impersonation, nonconsensual intimate imagery, or general Community Guidelines complaints. Those matters should be submitted through Contact/Support or the applicable specialized process.

Email is the fastest method. Use the subject “DMCA Copyright Notice” or “DMCA Counter-Notice,” as applicable.

If you believe material available through FilmShuffle infringes a copyright you own or are authorized to enforce, submit a written notice that includes substantially all of the following:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works at one online location are covered, you may provide a representative list.
  3. Identification of the allegedly infringing material and information reasonably sufficient for FilmShuffle to locate it, such as the exact FilmShuffle URL, username, post, review, comment, list, Club, or file location.
  4. Information reasonably sufficient for FilmShuffle to contact you, including your name, mailing address, telephone number, and email address, if available.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

A notice that does not substantially include the required information may be ineffective or delayed. FilmShuffle may contact you to request missing information.

3. What FilmShuffle may do after receiving a notice

When FilmShuffle receives a substantially compliant notice, it may:

  • remove or disable access to the identified material expeditiously;
  • preserve a restricted copy and case record as reasonably necessary for the notice and counter-notice process;
  • notify the user who submitted the material;
  • provide the user with a copy of the notice or relevant information from it;
  • record the matter for repeat-infringer review; and
  • take additional action under the Terms or Community Guidelines.

The information in your notice, including your contact information, may be forwarded to the user who posted the material or otherwise disclosed as required by law. Do not submit information you are not prepared to have included in that process.

Removal does not mean FilmShuffle has made a final legal determination about infringement.

4. Counter-notices

If your content was removed or disabled because of a copyright notice and you believe the action resulted from mistake or misidentification, you may send a written counter-notice to the Copyright Agent. The counter-notice must include substantially all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
  4. Your name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which FilmShuffle may be found.
  6. A statement that you will accept service of process from the person who submitted the original notice or that person’s agent.

FilmShuffle may send a copy of the counter-notice to the original claimant. If FilmShuffle receives a valid counter-notice, FilmShuffle may restore the material or stop disabling access not fewer than 10 and not more than 14 business days after receipt, unless the Copyright Agent first receives notice that the claimant filed a court action seeking to restrain the user from the allegedly infringing activity.

Restoration remains subject to the Terms, Community Guidelines, other legal obligations, and technical feasibility. Content will not be restored through the DMCA counter-notice process if it is independently prohibited for another valid reason.

5. Repeat infringers

FilmShuffle has adopted and reasonably implements a policy providing for termination, in appropriate circumstances, of account holders who are repeat infringers.

FilmShuffle evaluates repeat infringement based on the circumstances, including the number and reliability of notices, counter-notices, court outcomes, patterns of conduct, whether material was restored, and evidence of knowing or willful infringement. FilmShuffle may warn, restrict, suspend, or terminate an account before a fixed number of notices when circumstances warrant.

Submitting multiple notices does not guarantee automatic termination, and FilmShuffle may disregard notices that are invalid, abusive, fraudulent, withdrawn, or successfully countered.

6. Misrepresentations and abuse

Federal law may impose liability on a person who knowingly materially misrepresents that material is infringing or that material was removed by mistake or misidentification. Do not use this process to silence criticism, punish disagreement, or make claims you are not authorized to make.

FilmShuffle may restrict or refuse abusive notices, preserve evidence, or take action against accounts that misuse the copyright process.

7. Other intellectual-property complaints

For trademark, publicity, or other intellectual-property concerns that are not copyright claims under the DMCA, email contact@filmshuffle.app with the subject “Other Intellectual Property Concern.” Identify the right, the material, its location, your authority, and the requested action.

8. Changes

FilmShuffle may update this Policy to reflect changes in law, procedure, or the Service. The version posted on FilmShuffle controls from its effective date.
